JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 22.05.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Buxar (T) P. S. case no. 58/2015 registered under sections 406 and 420 of the Indian Penal Code.

Petitioner was In-charge Manager of the concerned petrol pump and when it was detected that there was defalcation of huge amount, petitioner and account clerk who happens to be informant of the present case gave an explanation to the concerned authority mentioning this fact that due to shortage of supply and giving petrol etc on credit, there was differences in the account of the concerned petrol pump and furthermore, petitioner as well as informant assured the concerned authority to compensate the differences, if they fail to collect the amount of petrol etc given on credit. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed

Patna High Court Cr.Misc. No.11738 of 2015 (3) dt.22-05-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in Buxar (T) P. S. case no. 58/2015 subject to conditions as laid down under section 438(2) of the Cr.P.C and further he shall cooperate the Investigating officer as well as the concerned authority in accounting of the concerned petrol pump.
