The petitioner is seeking anticipatory bail in connection with Parbatta P.S. Case No. 464/2018, G.R. No. 3530/2018 registered under Sections 30(a)/37(d) and 38(2) of the Bihar Prohibition and Excise Act, 2016, pending in the court of Incharge, Special Judge, Excise, Khagaria. Learned counsel for the petitioner submits that nothing has been recovered from the possession of this petitioner. It is submitted that the petitioner has no criminal antecedent and that a perusal of the seizure list would show that seizure of illicit liquor seized from a field adjacent to the Baithka of Amol Mandal.

No one appears for the State to oppose the prayer for anticipatory bail of the petitioner.

No.12271 of 2019(2) dt.05-03-2019 2/2 In the given facts and circumstances of the case where there is no recovery from the possession of this petitioner and he is said to be a man of clean antecedent, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Incharge, Special Judge, Excise, Khagaria, in connection with Parbatta P.S. Case No. 464/2018, G.R. No. 3530/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
