Prayer is for grant of bail in Sitamarhi P.S. Case No. 415 of 2016 registered for the offence under Sections 414/34 of the Indian Penal Code.

Petitioner had earlier moved for bail which was considered and rejected by order dated 10.11.2016 (Annexure-1) wherein he was granted liberty to renew prayer for bail after six months. It is stated that the petitioner has remained in custody for one year. He has no criminal antecedent.

Considering the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S. Case No. 415 of

Patna High Court Cr.Misc. No.28574 of 2017 (2) dt.28-06-2017 2/2 2016 subject to the following conditions:

(i) One of the bailers shall be the own/close family members of the petitioner.

(ii) In case of framing of charge, the petitioner shall appear in person on each and every date fixed in the Court below. In case of default in doing so on two consecutive occasions without any cogent/satisfactory reason, the Trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
