JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the records of this case and heard learned counsel for the State through virtual court proceeding. In the present case, the petitioner is seeking bail in connection with Hussainganj P.S. Case No. 263 of 2019 registered for offence punishable under Sections 30 (a), 38 (I), 41 (I) of Bihar Prohibition and Excise Act, 2016. As per allegation, about 279.360 liters of illegal liquor was recovered from the bush situated at Singarpatti to Sahbajpur Pitch Road, however, counsel for the petitioner submits that he has no concerned with the alleged recovery and he is in judicial custody since 15.01.2020 having no criminal antecedent. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on his personal bond due to the circumstance of total lock down

Patna High Court CR. MISC. No.12918 of 2020(2) dt.13-05-2020 2/2 on account of pandemic Covid-19 to the satisfaction of 2nd Additional District and Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Hussainganj P.S. Case No. 263 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
