Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in connection with Noorsarai P.S. Case No.267 of 2016 registered under Sections 25(1-b)a and 26 of the Arms Act.
The accusation is of recovery of one loaded country made pistol alongwith one live cartridge from the possession of the petitioner.
Learned counsel appearing on behalf of the petitioner submits that while the petitioner is accused in two other cases, as
Patna High Court Cr.Misc. No.20041 of 2017 (2) dt.17-05-2017 2/2 detailed in paragraph-3 to this application, but in both the cases, the petitioner is on bail. In the present case, the petitioner is in custody since 09.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif, in connection with Noorsarai Police Station Case No.267 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
