JUSTICE HEMANT GUPTA ORAL JUDGMENT Date: 08-09-2016 The petitioner has claimed G.P.F. amount for the work charge period from 1974 to 1988 and the benefits of 1st A.C.P., 2nd A.C.P and 3rd A.C.P. scale in the present writ application. In the counter affidavit dated 01.09.2014, the stand of the respondents is that the G.P.F. amount for the work charge period has since been paid vide demand draft dated 23.06.2014. It is also stated that since the services of the petitioner were regularized with effect from 1st of January, 1988, therefore, 1st time bound promotion is admissible after the said date on completion of the requisite number of years. In view of the Circular dated 23rd January, 2008, the pay was fixed in the pay scale of Rs.2650-4000/- with effect from 01.01.1996

Patna High Court CWJC No.6394 of 2014 dt.08-09-2016 2/2 which is equivalent to the pay scale of 1st A.C.P. He has been given 2nd A.C.P. in the pay scale of Rs.2750-4400/- with effect from 09.08.1999 and the 3rd M.A.C.P. in the grade pay of Rs.2400/- with effect from 01.01.2009. The said counter affidavit filed on 01.09.2014 has not been controverted by the petitioner.

Keeping in view the averments made in the counter affidavit, it appears that the grievances of the petitioner stand redressed. No further orders are called for in the present writ petition. Accordingly, the same stands disposed of.
