The petitioner apprehends his arrest in Sitamarhi P.S. Case No. 787 of 2014, registered for the offence punishable under Section 392 of the Indian Penal Code.

The informant being a passenger of the auto rickshaw alleged that two persons sat on auto rickshaw snatched his bag containing Rs. 60,000/- and gold jewellery.

It is submitted that the name of the petitioner figured in the case in confessional statement of Lallan Singh who disclosed the name of the petitioner. The petitioner has got no criminal antecedent.

It appears that father of the petitioner is the owner of the auto rickshaw and Lallan Singh was driving the auto rickshaw.

Patna High Court Cr.Misc. No.9277 of 2016 (3) dt.10-05-2016 2/2 The informant has very categorically made allegation that the two unknown passengers pushed him and looted away the bag containing cash and jewellery.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail in Sitamarhi P.S. Case No. 787 of 2014, pending in the court of the learned Chief Judicial Magistrate, Sitamarhi. Accordingly, the same is rejected.
