JUSTICE SANJAY PRIYA ORAL ORDER 25-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Mithanpura P.S. Case No. 356 of 2015 instituted for the offence under Sections-385 & 387 of the Indian Penal Code, 66A(b) I.T. Act and Secctions-16, 18 & 20 of UAP Act.

It has been submitted that the petitioner is in custody since 19-12-2015. He has clean antecedent.

From the written report, it appears that rangdari of Rs. One crore was demanded from the mobile and during investigation, the same was found in the name of this petitioner. It has been submitted that the petitioner is a handicapped person and he has been implicated in the case on account of dirty politics. The charge has not even been framed in

Patna High Court Cr.Misc. No.24339 of 2017 (2) dt.25-05-2017 2/2 this case.

Keeping in view the fact that the petitioner has clean antecedent and also the period spent by the petitioner in custody, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mithanpura P.S. Case No. 356 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate (East) Muzaffarpur subject to condition that both the bailors should be close relatives of the petitioner.
