Petitioner seeks bail in Barauni (Zero Mile OP) P.S. Case No.540 of 2018 instituted for the offence under Section(s) 188 Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that police having received information that three persons have shot the proprietor of Ishwar Medico, Vijay Rai @ Mato, at his shop, the police reached on NH 31 and found three persons fleeing away on motorcycle on seeing the police party. The police chased them and they fell down. Two persons were caught and one person

Patna High Court CR. MISC. No.13553 of 2019(2) dt.06-03-2019 2/2 managed to run away. It is alleged that one loaded country made pistol has been recovered from possession of the petitioner and two live cartridges were recovered from possession of another accused. It is further alleged that in the gathering the accused persons were assaulted and they also sustained injuries. Petitioner is in custody since 17.11.2018.

Keeping in view the period of custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act, Begusarai, in connection with Barauni (Zero Mile OP) P.S. Case No.540 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
