JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-03-2015 Heard learned counsels for the petitioners, informant and the State.
The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 504, 420, 419, 467, 468, 471, 406 of the Indian Penal Code and 3(i) (x), 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is alleged that the petitioners purchased an Auto rickshaw from the informant hypothecated by the State Bank of India after entering into an agreement to pay Rs.1,74,053/-. The petitioners had also assured that they will pay rest installment of Rs.3444/- per month to the bank but they failed to do so. Subsequently, the informant directed to deposit the premium due and he was subjected to assault and abuse. It is submitted by learned counsel for the petitioners that by making payment of entire consideration amount the vehicle has been purchased and maliciously the accusation under SC/ST Act has been levelled to make the accusation serious. A statement has been made in
Patna High Court Cr.Misc. No.12114 of 2015 (2) dt.24-03-2015 2/2 para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jamui in connection with Jamui SC/ST P.S. Case No.56 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. .
