JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Ladania P.S. Case No.220 of 2019 for the offence under Sections 272, 273, 414 of the I.P.C. and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

In the instant case total 19.80 litres of foreign liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that liquor was seized from the motorcycle, which does not belong to the petitioner and nothing was recovered from the conscious possession of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent and nothing was recovered from his conscious possession, the petitioner named above, in the event of arrest or surrender before the court below within one month

Patna High Court CR. MISC. No.10731 of 2020(2) dt.03-03-2020 2/2 from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Madhubani in connection with Ladania P.S. Case No.220 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
