JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 18-03-2026 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Begusarai Town P.S. Case No.339 of 2025 instituted for the offence under Sections 85 and 80(2) of B.N.S. and Sections 3 and 4 of Dowry Prohibition Act.
3. The case of the prosecution, in short, is that Neha Kumari (deceased) was married to one Niraj Kumar. At the time of marriage, sufficient gifts were given. It is alleged that she was subjected to cruelty on account of non-fulfillment of dowry demand. Ultimately, she was killed on 18.08.2025.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is mother-in-law and she has falsely been

It has further been submitted that main thrust of allegation is against husband of the deceased who is already in judicial custody. She is having no criminal antecedent. 5.Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of bail of the petitioner. Learned counsel for the informant has submitted that deceased was tortured by this petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Begusarai Town P.S. Case No.339 of 2025, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai, subject to the conditions as laid down under section 482 (2) of the B.N.S.S.
