The petitioner seeks bail in a case registered under Sections 457, 380 of the Indian Penal Code.

Allegation against the petitioner is that while the informant was sleeping in her house, one person i.e. the petitioner was taking materials from the boxes and he was identified on the place of occurrence. Allegedly, he took cash and ornaments. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-10-2018. Charge sheet has already been submitted. The petitioner has been made accused

Patna High Court CR. MISC. No.14325 of 2019(3) dt.02-05-2019 2/2 falsely in the present case. There is no other substantive evidence to suggest the implication of the petitioner in the present case. Due to village politics, he has been made accused. He has remained in custody for more than six months. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Banka in connection with Jaipur P.S. Case No. 23 of 2018.
