JUSTICE SANJAY PRIYA ORAL ORDER 25-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bhudaha Colony P.S. Case No.169 of 2016 instituted for the offence under Sections 420 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that mere suspicion has been raised against the petitioner. There is allegation that petitioner along with co-accused Mantun Kumar came to the house of the informant in respect of Patanjali Product and they took one golden ring of the informant for cleaning. When the informant after half an hour tried to take out the ring from water, he found only waste paper there. It has further been submitted that co-accused Mantun Kumar @ Muntun Kumar with similar allegation has been granted bail by a coordinate Bench of this Court vide order dated 3.5.2017 passed in Cr. Misc.

Patna High Court Cr.Misc. No.24383 of 2017 (2) dt.25-05-2017 2/2 21037 of 2017. Petitioner is said to be in custody since 16.2.2017.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Bhudaha Colony P.S. Case No. 169 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
