The petitioner is aggrieved by an order dated 12.122015, passed by the learned Additional Sessions Judge-II, Begusarai in Sessions Trial No. 845 of 2013, whereby he has rejected a petition under Section 228(1) (a) of the Cr. P.C. It was the petitioner case that there was no specific allegation as to who had caused the injuries and even the injuries were simple From the impugned order, I notice that the learned court below has noted after perusing the case record that there was sufficient material for framing charge for commission of the offence under Section 308 of the Indian Penal Code.
Patna High Court CR. MISC. No.13956 of 2015(2) dt.20-06-2019 2/2 At this stage, I do not find it appropriate to exercise the power under Section 482 of the Cr. P.C. to interfere with the order impugned. The application is accordingly dismissed. The petitioner shall be at liberty to take the plea, which has been stated in the present application at the appropriate stage before the court below.
