2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 354, 323, 506 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, petitioner tried to outrage modesty of the informant aged about 13 years by catching hold of her hands.

4. Learned counsel appearing for the petitioner submits that there is land dispute between the parties and earlier also, informant's mother had lodged case against the petitioner with similar allegation. It is submitted that mother of the informant had taken some money from the petitioner which she did not want to return and to put pressure, she lodged the instant case. F.I.R. has been lodged after delay of about six days

Patna High Court CR. MISC. No.21261 of 2024(2) dt.04-04-2024 2/2 without any explanation which renders the entire prosecution case doubtful.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, POCSO, Bhojpur in Tiyar P.S. Case No. 39-2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
