JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This application, for grant of anticipatory bail, arises out of Gardanibagh P.S. Case No. 310 of 2018, disclosing offences under Sections 498(A), 302, 120(B) and 34 of the Indian Penal Code.

Petitioners happen to be brother in law and sister of the husband of the deceased and allegation against them and others is of subjecting the deceased to cruelty and also causing her death.

Submission of learned counsel for the petitioners is that they are brother in law and sister of the husband of the deceased and has nothing to do with the affairs of deceased and her husband and has falsely been made accused in this case and

Patna High Court CR. MISC. No.11734 of 2019(3) dt.29-04-2019 2/2 further no specific allegation has been attributed to them. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IV, Patna, in connection with Gardanibagh P.S. Case No. 310 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
