Hussain, learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with K. Nagar (Champanagar) P.S. Case No. 492 of 2019 dated 06.12.2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Regard being had to the fact that there is recovery of 11 litres of liquor from the house of the petitioner, I am not inclined to exercise my discretion for granting anticipatory bail to him.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the

Patna High Court CR. MISC. No.33718 of 2020(2) dt.18-03-2021 2/2 court below and seeks bail, the court below shall consider the application on its own merits without being prejudiced by the fact that the present petition has not been entertained.
