2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 363, 366A/34 of Indian Penal Code.
3. It is alleged all the F.I.R. named accused persons including this petitioner kidnapped the daughter of the informant for the purpose of marriage.
4. Learned counsel for the petitioner submits that victim in her statement, recorded under Section 164 of Cr.P.C., has denied the prosecution case and has categorically stated that she left the house with the petitioner on 19.07.2023 on her own sweet will. Petitioner claims clean antecedent.
5. Considering the statement of the victim recorded
Patna High Court CR. MISC. No.24503 of 2024(3) dt.24-06-2024 2/2 under Section 164 of Cr.P.C., this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ara, Bhojpur in connection with Ara Nawada P. S. Case No. 532 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
