JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Hajipur (Town) Police Station Case No. 598 of 2014 registered for the offences punishable under Sections 420 of the Indian Penal Code.
Admittedly, petitioner is tenant of informant and accusation against him is that he got electric connection in his rented room by placing forged documents before the officials of Electricity Department.
The contention on behalf of the petitioner is that prior to institution of the present case the informant had given petition to Superintendent of Police, Vaishali and pursuant to that petition

No.9323 of 2015 (2) dt.09-03-2015 2/2 the accusation was inquired and verified by a police official, who found the allegation untrue but after that the informant lodged the present case. It is further contended on behalf of the petitioner that the witnesses, who had supported the stand of the petitioner in course of the above stated inquiry, turned hostile to the petitioner and supported the case of the informant in course of investigation of the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali in Hajipur (Town) Police Station Case No. 598 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
