JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 504, 506 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.

There is general and omnibus allegation against all the four named accused persons to have caused injury with Lathi etc to the deceased. The Doctor has found single injury on the person of the deceased. Further specific allegation against the petitioner is of commission of injury at the nose of the informant. Petitioner is in custody since 22.09.2017.

Learned counsel for the informant opposed

Patna High Court Cr.Misc. No.1741 of 2018 (3) dt.21-02-2018 the prayer for bail.

However, it is not disputed that there is no other material in the case diary. The police has already submitted chargesheet in this case.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Maner Police Station Case No.291 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
