The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is Secretary of the concerned ward and the informant alleges that despite allotment of funds under the Chief Minister Rural Drinking Water Scheme, all the accused persons including the petitioner did not completed the work within stipulated period and same is still pending. The learned counsel submits that the petitioner has been falsely implicated in the present case being Secretary of the Ward he has also instituted an FIR being Dhaka P.S. Case
Patna High Court CR. MISC. No.13163 of 2023(2) dt.24-05-2023 2/2 No. 56 of 2021 against the contractor. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that allegation is not of misappropriation but that work was not completed within the stipulated time and is still pending.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Dhaka P.S. Case No. 561 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
