Petitioner seeks regular bail in Khagaria (Mufassil) P.S. Case No.634 of 2016 instituted for the offence under Sections 302, 201, 120((B)/34 of the I.P.C., and Section 27 of the Arms Act Informant is the brother of the deceased Arun Yadav who in his F.I.R. has stated that on 10.11.2016 he had gone to Sadar Hospital, Khagaria and found dead body of deceased Kare Yadav and thereafter he was informed that one more dead body of his brother Arun Yadav was also lying there. It has further been alleged that on 7.11.2016 seven accused including the petitioner had taken both of them and killed both of them.

No.2712 of 2018 (3) dt.12-02-2018 2/2 It has been submitted by the petitioner that no any sanaha for missing of any person or any F.I.R. was lodged by the informant between 7.11.2016 to 10.11.2016 and there is admittedly land dispute and serious enmity between the parties and as such the petitioner has been falsely implicated in this case by the informant. There is only suspicion against the petitioner. He is in custody since 21.08.2017.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Khagaria, in Khagaria Mufassil P.S.Case No.634 of 2016..
