Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 323 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that when the police party raided a house to arrest co-accused wanted in some other case, petitioners started pelting stone on the police party and finally they got the said wanted co-accused freed from the police custody.

Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. Petitioners have got no criminal antecedent.

Patna High Court CR. MISC. No.11250 of 2020(2) dt.22-06-2020 2/2 Learned counsel for the State opposes the prayer for bail. He submits that the petitioners put hindrance in discharge of duty by the police party which had raided a house to nab a dreaded criminal. They were armed with lathi. They surrounded the police party and abused the police personnel. Considering the nature of allegation, prayer for bail of all the petitioners is refused with direction to surrender and seek regular bail which would be considered on its own merit without prejudice.
