JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-04-2015 Heard learned counsel for the petitioner and the state. The present application has been filed for modification of order dated 7.2.2011 passed in Cr. Misc. No. 1475 of 2011 for extending the period of surrender.

It appears that the petitioner was granted anticipatory bail in connection with Akilpur P.S. Case No. 4 of 2010 but failed to furnish the bail bonds and subsequently moved the learned Sessions Judge for anticipatory bail vide ABP No. 19927 of 2014 which was dismissed as not maintainable vide order dated 9.12.2014 by the learned Sessions Judge, Patna. In the circumstances, this court is not inclined to entertain the present modification application. However, let the learned court below consider the prayer for regular bail of the

Patna High Court Cr.Misc. No.13989 of 2015 (2) dt.15-04-2015 2/2 petitioner in case the petitioner surrenders within six weeks from today in connection with the aforementioned case keeping in view of the fact that petitioner was granted anticipatory bail on merits. This modification application is disposed of with the aforesaid observation/direction.
