JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-02-2016 Heard learned counsels for the petitioners and the State. The petitioners being parents of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302,201 and 120B/34 of the Indian Penal Code.
The accusation is of killing the daughter of the informant for non fulfillment of dowry demands of rupees forty thousand.
It is submitted by the learned counsel for the petitioners that admittedly the victim died after 12 years of marriage and the FIR stipulates that the marriage was performed in the year 2003
Patna High Court Cr.Misc. No.8572 of 2016 (2) dt.23-02-2016 2/2 though it is an error of record in the impugned order where it has been recorded that the marriage was performed in 2007. It is further submitted that the accusation is omnibus and general and the thrust of accusation is against the husband of the victim who is in custody.
Considering the accusation being omnibus and general against the entire in-laws family, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Aurangabad Town P.S. Case No.503 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
