The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 447, 302, 504 of the Indian Penal Code.
The prosecution case is that the accused persons including the petitioner came with deadly weapon and assaulted the brother of the informant namely Sanjay Yadav. When the informant's father and two other brothers Daya Nand Yadav and Putul Yadav came to the place of occurrence, they were also assaulted by the accused persons. Subsequently, the brother of the informant Sanjay Yadav succumbed to the injury.
Patna High Court Cr.Misc. No.9048 of 2016 (2) dt.26-02-2016 It is submitted by the learned counsel for the petitioners that accusation is not specific against the petitioners and only omnibus and general accusation has been levelled against them.
Consideration the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the bail application stands dismissed. However, petitioner will be at liberty to surrender and pray for regular bail.
