This application, for grant of anticipatory bail, arises out of Complaint Case No. 2188 of 2008, disclosing offences under Sections 302/120B of the Indian Penal Code. A First Information Report was earlier registered under Section 156 (3) of the Code of Criminal Procedure, 1973, on the basis of complaint case. The Police appears to have submitted final report finding the case to be false. However, on

No.15893 of 2019(2) dt.14-03-2019 2/3 the basis of protest -cum- complaint petition filed by the informant, the Court below has taken cognizance of the offence punishable under Sections 302/120B of the Indian Penal Code. Learned Counsel appearing on behalf of the petitioners has submitted that the deceased, informant's husband, had died of accidental drowning and all persons, with whom the informant was on inimical terms, have been falsely implicated in the criminal case.

Considering the circumstance that no investigation is pending and upon conclusion of investigation, final report had been submitted by the Police, exonerating the petitioners of allegation made in the complaint petition, in my view, a case for grant of privilege of anticipatory bail is made out. Accordingly, this application is allowed.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIV, Bhagalpur, in connection with Complaint Case No. 2188 of 2008, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
