The petitioner seeks bail in Kangali P.S. Case No. 13 of 2017 instituted for the offence under Section-20(b)(ii)B, NDPS Act.

It has been submitted that the petitioner has clean antecedent. As per written report, 2.5 kgs of Ganja is alleged to have been recovered from possession of the petitioner and one Shatrughan Sahani, who were going on motorcycle. The seizure list has been prepared, which is enclosed with the FIR. The seizure list does not bear signature of this petitioner. The C.D. has been received.

The learned APP has submitted that the report of

Patna High Court Cr.Misc. No.21714 of 2017 (3) dt.28-06-2017 FSL, has not been received till date although sample has been sent for examination.

Counsel for the petitioner has submitted that the alleged Ganja will come below the commercial quantity. The petitioner is said to be in custody since 10-02-2017.

In the aforesaid circumstances as also considering the clean antecedent of the petitioner, prayer for bail is allowed. The petitioner, named above is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount in connection with Kangali P.S. Case No. 13 of 2017 to the satisfaction of learned Sessions Judge, Bettiah, West Champaran subject to condition that both the bailors should be close relatives of the petitioner.
