KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406 and 420 of the I.P.C.

Allegation against the petitioner is that the other coaccused person Baijnath Sah used to run a Non-Banking Company in which the informant has deposited some amount. It has been further alleged that Radheshyam Sah has given an undertaking that at the time of maturity he will pay him as per the companies' scheme. But when the amount of informant was matured he was not paid his amount. Even after maturity time was given but payment was not made to the informant. Then the informant has lodged the F.I.R.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.29278 of 2017 (2) dt.07-07-2017 2/2 there is no specific allegation against the petitioner regarding collection of money, the petitioner only co-operate the NonBanking Company, and the informant demanded his mature amount from co-accused Baijnath Sah. The petitioner has no criminal antecedent and is in custody since 02.05.2017. Heard learned A.P.P. also.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M. Samastipur, in connection with Kalyanpur P.S. No. 164 of 2016. (S. Kumar, J) khushbu/- U T
