JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.
The prosecution case is that the informant entered into an agreement for brick-kiln business on 08.08.2011 with Sanjay Kumar and Upendra Kumar. The informant claimed to have given Rs. 13 lakhs to Sanjay Kumar on various dates but after three years, Sanjay Kumar transferred the brick-kiln to the petitioner who is the petitioner of Sanjay Kumar by changing the name of firm and when the informant went to demand his money then he was being assaulted.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.8906 of 2016 (2) dt.25-02-2016 2/2 the thrust of accusation is against Sanjay Kumar with whom the informant entered into agreement. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda, Bihar Sharif in connection with Asthawan P.S. Case No. 71 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
