In this case, the petitioner is apprehending his arrest in connection with Barachatti P.S. Case No. 632 of 2018 registered for offences under sections 341, 323, 307, 504, 506/34 of the Indian Penal Code.

In the present case, the alleged incident has taken place on 29.8.2018 but, the complaint petition has been filed after delay of one month i.e. on 23.9.2018.

The allegation has been made that the accused persons including the petitioner have made injury on the Informant by Tangi, whereafter, the victim was admitted in the Hospital and was under treatment.

Learned counsel for the petitioner submits that the

No.15408 of 2019(2) dt.13-03-2019 2/2 alleged injury is simple in nature and earlier the petitioner has filed an application against the present Informant about assault made upon him but, the police has not lodged the case. Since the First Information Report has been lodged after a delay of one month, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S. Case No. 632 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
