Mr. Binod Kumar 3 ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 14-05-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Amarpur P.S.Case No. 471 of 2017 registered under Sections 392 and 411 of the Indian penal Code. Allegation in brief is that while informant was returning back to his home after withdrawing Rs. 5000/- from the bank, on the way robbed by miscreants and on alarm raised by him, local people chased the petitioner and apprehended and recovered Rs. 5000/- from the possession of the petitioner. Submission is that it was his personal money and petitioner has no criminal antecedent.

However, petitioner was apprehended at the spot after chasing away and recovery was also made from his possession and prayer of bail of another co-accused Shanu Ghosh was earlier rejected by this Court.

Patna High Court Cr.Misc. No.28656 of 2018(2) dt.14-05-2018 2/2 Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioner is rejected. The trial court is directed to expedite the trial and conclude the same preferably within six months.
