JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with C III Case No. 58 of 2014 registered for the offence punishable under Section 47 A of the Excise Act.

Taking into consideration that in huge quantity illicit liquor was recovered from the house of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with C III Case No. 58 of 2014 pending in the court of Chief Judicial Magistrate, Siwan stands rejected.

Patna High Court Cr.Misc. No.6622 of 2015 (2) dt.19-02-2015 However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
