The petitioner seeks regular bail in connection with Beur P.S. Case No. 105 of 2017, registered for the offence punishable under Sections 272 and 414 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act, 2016.

The allegation levelled by the informant is that on secret information having been received with regard to certain persons having assembled at the place of occurrence, a police team was constituted and raid was conducted at the place of occurrence, where one Nano car was found with some persons including the petitioner and thereafter on search being made, certain quantity of illicit liquor was found and recovered from the bushes. Patna High Court Cr.Misc. No.29001 of 2017 (2) dt.01-07-2017 2/2 petitioner that no recovery has been made either from the car or from possession of the petitioner. It is the further submission that the petitioner is of a tender age, he has no criminal antecedent and he is in custody since 11.05.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exciose, Patna in connection with Beur P.S. Case No. 105 of 2017.
