The petitioner seeks bail in Case No. C2/231/19 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The S.S.B. intercepted Mahindra Bolero bearing Registration No.BR31G-A-9806 and recovered 7200 bottles containing Nepali Saufi wine. Each bottle contains 300 ml. Learned counsel for the petitioner submits that Liladhar Rai was driving the Bolero pick up van in which Nepali Saufi wine was loaded. Liladhar Rai disclosed that I am the owner of the liquor. There is no other material save and except the statement of Liladhar Rai to show that the petitioner got the liquor transported from the vehicle of Liladhar Rai from

Patna High Court CR. MISC. No.11003 of 2020(2) dt.03-03-2020 2/2 Nepal to Indian territory. The petitioner is in jail since 14.01.2020. It is further submitted that the petitioner is made accused in two other cases registered under the Excise Act but in those two cases also, name of the petitioner figured in the confessional statement of co-accused.

Taking into consideration the facts aforesaid, petitioner, namely, Rajiv Mandal @ Rajeev Mandal is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/231/19.
