JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 75 of 2007 registered for the offences punishable under Sections 25(1-B) A, 26, 35 of the Arms Act. There is allegation against the petitioner that he managed to escape from the place of occurrence and admittedly, the alleged occurrence was registered in the year 2007 and petitioner has come before this court in the year 2015. Although, it is submitted that summon was received by the petitioner in the year 2015 but I am not, at all, convinced with the above stated submission and accordingly, the prayer for anticipatory bail of the petitioner in connection with Kotwali P.S. Case No. 75 of 2007 pending in the court of Sri Syed Qamrul

Patna High Court Cr.Misc. No.11005 of 2015 (2) dt.20-03-2015 Hassan Rizvi, Judicial Magistrate 1st Class, Gaya stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
