JUSTICE ANIL KUMAR SINHA ORAL ORDER 05-11-2019 Heard learned Counsel for the parties concerned. This application, for grant of anticipatory bail, arises out of Complaint Case No. 2860C of 2017, in which cognizance has been taken against the petitioner under Section 498A of the Indian Penal Code.
The petitioner is the husband of the Opposite Party No. 2 and there appears to be matrimonial discord between them. By order, dated 27.06.2019, the matter was referred to the District Mediation Centre, Araria. The report of the learned Mediator, dated 24.09.2019, is on record. From perusal of the same, it appears that both the parties have already settled their disputes amicably and a joint memorandum of agreement, dated
Patna High Court CR. MISC. No.12094 of 2019(8) dt.05-11-2019 2/2 19.09.2019, have been signed by the parties.
In view of the fact that both the parties have amicably settled their disputes, the provisional bail granted to the petitioner, by order, dated 27.02.2019, is hereby confirmed subject to the condition that both the parties shall abide by the terms and condition of the joint memorandum of agreement, dated 19.09.2019.
