JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 31-08-2022 Learned counsel for the petitioner submits that the certain defects were pointed out at the time of inspection for starting a D.El.Ed course for additional intake of B.Ed as well as D.El.Ed course.

Learned counsel for the petitioner submits that the petitioner later on were able to meet the requirements as per the norms laid down and they have also acquired a larger piece of land. Learned counsel submits that after having enquired the requisite area of land, the petitioners have submitted an application on 15.11.2017 for reconsidering the application of the petitioner but the same remained undecided. Learned

Patna High Court CWJC No.7024 of 2021(2) dt.31-08-2022 2/2 counsel submits that the respondents be directed to reconsider the application of the petitioner.

In the opinion of this court, the refusal by the N.C.T.E. was in the year 2017. Thereafter, no further steps were taken by the petitioner against the refusal. The writ petition has been preferred in 2021.

In view of the long delay, the prayer made by the petitioner's counsel cannot be accepted. However, the petitioner would be free to move a fresh application bringing out all the submissions of having necessary infrastructure, which they possess in terms of the present norms laid down by the N.C.T.E. If such an application is moved, the NCTE while examine the case of the petitioner afresh without being influenced by its earlier order.
