JUSTICE RAJIV ROY ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner and the learned APP for the State The petitioner apprehends his arrest in connection with Azamnagar P.S. Case No. 29 of 2020 instituted under Section 376 of the Indian Penal Code lodged on 07-02-2020 by the informant Reeta Kumari.

As per the prosecution story, the informant that one year ago her parents went to the house of the petitioner for giving proposal of marriage, but the same was not settled on account of non-fulfillment of demand as alleged by the complainant. It is further alleged that on October 2019, the accused petitioner came to her house and allured and assured for marriage with her and in the pretext of marrying with her, the accused-petitioner exploited sexually with prosecutrix against

Patna High Court CR. MISC. No.13369 of 2023(2) dt.23-05-2023 2/2 her will and latter on he refused to marry with her. The allegation is of year 2019 and it is only in 2023 that the petitioner has chosen to take steps for anticipatory bail. Certainly, it is not a fit case for extension of said relief.

Accordingly, the anticipatory bail petition stands rejected.
