Apprehending their arrest in Chainpur P.S. Case No. 202 of 2017 registered under Sections 341, 323, 307, 504,34 of the Indian Penal Code and section 27 of the Arms Act, the petitioners have prayer for grant of anticipatory bail. It is stated that owing to land dispute, the occurrence had taken place. Both parties scuffled in which the allegation of causing injury by gun shot is specifically attributed to Bilas Singh. There is general allegation against petitioner no. 1 of firing. Petitioner no. 2 was allegedly armed with tangi but there is no injury caused by tangi to any one. The accused party had also lodged a case against the present prosecution party vide

Patna High Court Cr.Misc. No.2734 of 2018(2) dt.15-01-2018 2/2 Annexure-2. It is submitted that considering the aforesaid facts of the case, two of the co-accuseds have been granted anticipatory bail vide order dated 29.11.2017 (Annexure-4). Let the petitioners abovenamed, in the event of their arrest or surrender in the Court below within four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II Kaimur at Bhabua in Chainpur P.S. Case No. 202 of 2017 (G.R. No. 1899/2017) subject to the condition as laid down under Section 438(2) of the Cr.P.C. with further condition that one of the bailors shall be own/close family members of the petitioners.
