The petitioner seeks regular bail in connection with Barh P.S. Case No. 741 of 2022, registered for the offences punishable under Sections 25 (1-b) a, 26 and 35 of the Arms Act.

As per the prosecution case, the petitioner was arrested with one loaded country made pistol, two live cartridges and a mobile alongwith other co-accused persons.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case only on the basis of suspicion. Petitioner is a student having no criminal antecedent and has been languishing in jail since 15.11.2022. Charge-sheet has already been filed. He further submits that the similarly

Patna High Court CR. MISC. No.13907 of 2023(2) dt.10-05-2023 2/2 situated co-accused person, namely, Vivek Kumar has already been granted regular bail vide order dated 24.02.2023 passed in Criminal Misc. No. 12756 of 2023 by a Co-ordinate Bench of this Case.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and considering the submission of learned counsel for the petitioner that petitioner is a student having no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Barh P.
