The petitioners, who are in custody, seek bail in connection with Fulwariya P.S. Case No. 188 of 2017 registered for the offence punishable under Sections 147, 148, 149, 307, 323, 324, 325,354A, 379, 504 and 506 of the Indian Penal Code. Informant in his fardbeyan has alleged of abusing and assaulting family members and there is long dispute between the families. The allegation against the petitioner No. 1 is of causing Farsa injury on the head of informant Ruchi Devi and nature of injury has been found to be simple. Allegation against petitioner No. 2 Chandrika Bhagat is of causing spear
Patna High Court Cr.Misc. No.15952 of 2018(3) dt.06-04-2018 2/2 blow on Binda Devi but same did not hit Binda Devi and allegation against petitioner No. 3 Basudeo Sah is of causing injury on the head of Rambir Bhagat and all injuries have been found to be simple nature.
It has been submitted that there is marriage of daughter of petitioner No. 1 on 24.04.2018 and they have no criminal antecedent. There is case and counter case about the same incident lodged by petitioners also.
Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, XIII, Gopalganj, in connection with Fulwariya P.S.
