JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-03-2020 The petitioner seeks bail in connection with Gaya R.P.F. Case No. 26 of 2019 instituted for the offences under Section 3 of the Railway Property (Unlawful Possession) Act, 1966.
The computer peripherals which were booked from Anand Vihar railway station were looted. In the C.C. T.V. footage, ten persons were identified. The petitioner is not named as one of the persons identified while entering the train and restraining other passengers from entering the compartment. However, a looted scanner has been recovered from the
Patna High Court CR. MISC. No.13229 of 2020(2) dt.02-03-2020 2/3 possession of the petitioner.
The learned counsel for the petitioner submits that from the possession of another co-accused, a monitor has been recovered but he has been granted bail on consideration of the fact that he does not have any criminal antecedent.
The learned counsel for the petitioner further submits that he had obtained the scanner for a consideration without knowing that the same was a stolen property.
Though the petitioner has earlier been made accused in two other cases but in both the cases, he is on bail.
The petitioner is in custody since 26.10.2019. Considering the period of custody of the petitioner and the nature of accusation against him, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) with sureties of the like amount each to the
