In this case, a report was called for on 22.3.2023. The same has since been received vide letter no. 71 dated 31.3.2023 of the learned Additional District & Sessions Judge-VI, Danapur. As per it, the trial is at the stage of hearing on the point of charge.

The prosecution story, in brief, is that the informant has alleged in the FIR that the marriage of the victim lady was solemnized nine years ago with the petitioner herein Mani Lal Yadav and right from the beginning they were demanding dowry and on the fateful day it was alleged that after pouring kerosene oil the accused persons including the petitioner

It has been submitted by learned Senior Counsel that the petitioner is ready to abide by all the terms and conditions, if granted relief.

Considering all the facts as also that he do not have any criminal antecedent and has remained in custody since 26.07.2021 (as stated in para 23 of bail application), this Court is inclined to grant him the privilege of bail subject to strict conditions.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur, Patna in connection with Khiri More P.S. Case No. 30 of 2020 subject to the following conditions:

(i) one of the bailor should be the family member of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear every day before the Trial Court and failure to do so without plausible reason will entail cancellation of his bail bond by the Trial Court itself; (iii) the petitioner shall appear before the concerned

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the application is allowed.
