JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State assisted by learned counsel appearing on behalf of informant through video conferencing.
The petitioner apprehends his arrest in connection with Sahpur P.S. Case no. 327 of 2019, registered under Sections 323, 379, 504 and 498(A) of the Indian Penal Code and Section 3 / 4 of D.P. Act.
The accusation is that the Nikah of informant Khushnuma Begam was performed on 05.04.2016 with Reyaz Ahmad Khan @ Laddan Khan (petitioner) and she went at her matrimonial house, while she was kept there properly for

No.13064 of 2020(2) dt.23-07-2020 2/3 some times, but, thereafter, her husband Reyaz Ahmad Khan @ Laddan Khan (petitioner) used to come in house along with his friends, in drunken state, when she made protest then she was being assaulted by her husband. Thereafter, she made compliant to her in-laws, but they also started taking favour of his son (petitioner). Later on, she was being tortured by her husband and other in-laws through various modes and her personal belongings were also snatched. When she gave information to her parents, who came to take her in Bidai, but, at that time, her husband (Petitioner) made demand of Rs. 50,000/- saying that if the demand will not be fulfilled, informant will be kept by her parents.
Learned counsel for the petitioner submits that, in fact, informant Khushnuma Begam, who is the wife of petitioner, does not want to live with the petitioner and only to give undue pressure, she lodged the present case, while petitioner is ready to keep the informant.
On the other hand, learned counsel appearing on behalf of informant opposed the prayer for pre-arrest bail of petitioner and submits that, in fact, due to ill behaviour of the petitioner, informant is in fear to live with the petitioner. Having regard to the facts and circumstances of

No.13064 of 2020(2) dt.23-07-2020 3/3 the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Bhojpur at Ara in connection with Sahpur P.S. Case No. 327 of 2019, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
