This appeal has been filed against the order dated 27.02.2015 passed by the Sub Judge-I, Sitamarhi in T.S. No.101of 2005 valued at Rs.95,000/- only. As the value of the suit is less than Rs.10 lacs, the first appeal against the impugned order of the Sub Judge lies before the Court of District Judge and not before this Court. Appellant is directed to file a miscellaneous appeal before the Court of District Judge, Sitamarhi after taking back the memo of appeal from this Court. On filing the appeal by the appellant, the learned lower Court is directed to dispose it of as expeditiously as possible.

Accordingly, this appeal stands disposed of.
