JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 09-04-2019 The petitioner has sought a direction to the respondent authorities for being appointed as an AASHA worker in the event of the earlier AASHA worker, posted at Anganbari Centre No. 246, having died.

2. It has been submitted on behalf of the petitioner that on the death of an AASHA worker at Anganbari Centre No. 246, an application was made by the petitioner for her appointment. On such application, Aam Sabha was called and the name of the petitioner was recommended. Despite such recommendation and the petitioner making this fact known to the authorities concerned, no appointment letter has been issued to the petitioner. The District Magistrate, Muzaffarpur, who too was represented by the petitioner, has only asked for a report from the Civil Surgeon-Cum-Chief Medical Officer, Muzaffarpur and, thereafter, has taken no decision with respect to appointment of AASHA worker at Anganbari Centre No. 246.

The petitioner therefore, under the aforesaid circumstances, is directed to make a fresh representation before the District Magistrate, Muzaffarpur (respondent No. 4), who, on finding the averments made before this Court to be true and verifying further facts, would pass necessary order in accordance with law, within a period of four weeks

Patna High Court CWJC No.5185 of 2019 dt.09-04-2019 3/3 from the date of receipt of such representation. It is also clarified that such representation shall be filed by the petitioner within a period of four weeks from the date of passing of this order.

4. With the aforesaid observation/direction, the writ petition stands disposed off.
