2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 18.05.2023 passed in Cr. Misc. No. 24093 of 2023.

3. The petitioner seeks regular bail in connection with Chakai P.S. Case No. 120 of 2022 registered for the offence under Sections 304B/302 of the Indian Penal Code.

4. As per the prosecution case, the petitioner is the husband of the deceased who is alleged to have killed his wife after six years of marriage.

5. The learned counsel for the petitioner submits that the petitioner is in custody since 31.05.2022 and has clean antecedent.

6. The learned APP for the State has vehemently opposed the prayer for bail.

7. From the post-mortem report, it appears that no external injury has been found on the body of the deceased. Viscera was preserved during post-mortem. The report is not there on record.

8. The report from the trial court was called for about the stage of the trial. The trial court has submitted a report that no witness has been examined in this case.

9. Considering the period of custody and also considering the fact that the trial is being delayed, this application for regular bail is allowed.

10. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Jamui/concerned Court below in connection with S.T. No. 562 of 2022 arising out of Chakai P.S. Case No. 120 of 2020 subject to condition that:- 7(i) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court personally or through his lawyer.
