JUSTICE SANJAY PRIYA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Itarhi P.S. Case No. 05 of 2017 instituted for the offence under Sections-25(i-b)a/26 of the Arms Act.
As per written report, one country-made pistol and two live cartridges were recovered from possession of the petitioner. The petitioner is said to be in custody since 09-01-2017. Learned counsel for the petitioner submits that earlier he has been made accused in Buxar (M) P.S. Case No. 133 of 2004 for the offences under Sections-302, 201/34 of the Indian Penal Code and he was on bail in that case. The trial of that case is coming to an end. Learned Sessions Judge has mentioned in the impugned order that charge sheet has already been submitted
Patna High Court Cr.Misc. No.20878 of 2017 (4) dt.23-06-2017 2/2 against the petitioner in this case.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Itarhi P.S. Case No. 05 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Buxar subject to condition that both the bailors should be close relatives of the petitioner.
